Discussion Questions
Why do courts need to be independent of outside influences? What is the biggest threat to judicial independence in your country? What is the relationship between the executive and the judiciary in your country? What are the advantages and disadvantages of this relationship? Should judges be elected or appointed, and why? What mechanisms are available in your country to ensure judicial integrity? Do these mechanisms work? How do financial considerations, such as judges' salaries, affect judicial independence and judicial integrity? In the United States, a federal judge can be removed only if convicted of "high crimes and misdemeanors," and judges' salaries cannot be reduced while they are in office. How does this impact judicial independence? When should a court have exclusive authority to decide which cases they want to hear? |
